Yes — you can rent out a BC presale condo. Strata rental-restriction bylaws have been unenforceable across British Columbia since November 24, 2022, so no strata can stop you from signing a long-term tenant. What can cost you money is everything around that decision: renting instead of moving in can forfeit up to $50,000 of GST rebate, and leaving the unit empty in 2026 now triggers the speculation and vacancy tax at 1% of assessed value — double the old rate. This is one of the most common questions we get from buyers holding a presale contract that completes in 12 to 30 months: "Can I just rent it out?" The answer is almost always yes. The better question — the one nobody at a presentation centre walks you through — is what renting it does to your tax position. Get the order of operations wrong and it's a five-figure mistake on a $750,000 unit. Can the strata stop you from renting? No. Bill 44 the Building and Strata Statutes Amendment Act received Royal Assent on November 24, 2022 and immediately made strata rental-restriction bylaws unenforceable in BC. That includes bylaws already registered before that date, rental caps, and waitlists. Age restrictions were also struck down except for genuine 55+ seniors housing. One thing survived: stratas can still restrict or ban short-term accommodation — licences to occupy of less than 30 days. So a building can legally prohibit Airbnb-style rentals while being powerless to stop a 12-month tenancy. If a sales rep tells you a building "allows rentals" as though it's a selling feature, that's not a feature — it's the law everywhere in BC. Ask instead what the short-term accommodation bylaw says, because that one is still real. Short-term rentals: mostly off the table in the Fraser Valley BC's Short-Term Rental Accommodations Act applies a principal residence requirement in every municipality over 10,000 people — which covers Surrey, Langley, Abbotsford, Coquitlam, Delta and Burnaby.
